BASIS FOR PROCESSING YOUR DATA

Under UK GDPR and the Data Protection Act 2018, we are required to have a lawful basis for processing your personal data. We rely on the following lawful bases:

Contract Performance: where processing your data is necessary to fulfil a purchase you have made or to provide the services you have requested, including managing your account and delivering course or membership access.

Legal Obligation: where we are required to process your data to comply with a legal obligation, for example retaining financial records for tax and accounting purposes.

Legitimate Interests: where processing is necessary for our legitimate business interests, including fraud prevention, IP address monitoring to detect unauthorised account sharing, and ensuring the security of our website and services, provided those interests are not overridden by your rights.

PERSONAL INFORMATION

When you use or purchase from this website or via affiliate links on this website, IOM and TFE shall collect certain Personal Information from you. Personal Information is information that can be used to identify you personally and includes but is not limited to your name, address, phone number, and email address. When you make a payment for anything on this website, IOM and TFE will receive certain credit card, PayPal or other payment information from you and such information will be provided to third party payment processors, for example, Stripe and PayPal. We only collect personal data that is necessary for the purposes set out in this policy.

DATA RETENTION

We will only retain your personal data for as long as is necessary to fulfil the purposes for which it was collected, including satisfying any legal, accounting or reporting requirements. As a general guide, we retain purchase and financial records for a minimum of 6 years in accordance with HMRC requirements. We retain your account data for as long as your account remains active and for a reasonable period thereafter in case of any queries or disputes. NON PERSONAL IDENTIFIABLE INFORMATION

We also obtain certain Non-Personal Information about you. This is generalised information and can not always be used to easily identify you personally. EMAILS

We use email as the primary form of communication with you. Where a membership is running, we may also use messages within our forum services. If you choose to email us or use the forum messenger system, we may retain the content of your email or forum messages together with our responses. It is IOM's company policy to store a copy of all purchase emails for good record keeping in case there is a query with your purchase.

Emails are not recognized as a secure means of communicating sensitive information. Therefore, please do not send us card details or other secure details via email. When we process your card or payment details, we do so on the website using an SSL. This is a secure method of processing payments.

IP ADDRESSES

Your IP address is your unique computer address which is made up of a series of numbers. It is used by your computer when you access the internet. We will collect your IP address as part of providing services to you. We also store your IP address in our databases. Amongst other things, we will use your IP address to identify you as the user of the course or membership services. Our systems will detect when a different IP address is used to prevent other people logging in on your account which is against our terms and conditions.

THIRD PARTY PROCESSORS

In order to operate our business and deliver our services, we share your personal data with certain trusted third party processors. These are companies that process data on our behalf and are required to do so only in accordance with our instructions and applicable data protection law. Our current third party processors include but are not limited to: Stripe and PayPal for payment processing, Kajabi for website hosting, payment processing,  course delivery and membership management and Google Analytics for website analytics. Where any of these processors are based outside the UK, we ensure that appropriate safeguards are in place to protect your data in accordance with UK GDPR, including relying on adequacy decisions or standard contractual clauses where applicable.

INTERNATIONAL DATA TRANSFERS

Some of our third party processors are based outside the UK and as a result your personal data may be transferred to and processed in countries outside the UK. Where this happens, we take steps to ensure that your data receives an equivalent level of protection as it would within the UK. This includes ensuring that any transfers are made to countries that have been deemed adequate by the UK Government, or that appropriate safeguards such as standard contractual clauses are in place.   • Disclosure to Third Party Service Providers - If we use a Third Party Service Provider to provide any or all of the IOM and TFE services to you, we may provide Personal Information about you to them. For example, we use PayPal and Stripe to process payments for the membership. This requires us to provide them with your personal information including your name, payment details, and other such information. We only disclose the minimum information required by such service providers in order to carry out their obligations.
  • Disclosure by Law - We reserve all rights to disclose any information about you as required by law. This includes disclosing information to enforce or protect IOM's / TFE's rights, or the rights of a third party or to prevent an emergency or in situations where we are required by law to disclose any information about you.
  • Owners of IOM - If at any point should the owner of IOM or TFE change or additional shareholders be appointed, we reserve the right to share information with them. This situation means that in the event of a merger or sale of all or substantially all of the shares or assets of IOM, your Personal Information will most likely be part of the transaction.

GENERAL USE OF INFORMATION

In general, we use your Personal Information for the purposes of running and administering our business activities, providing customer service and making our services available to you and prospective customers. You have the choice whether to agree or disagree with providing personal information to us. If you do not wish to provide such information, you would not be able to purchase from IOM or TFE or be a member of courses or memberships. 

We do not sell your personal information. We also will not transfer your information to unaffiliated third parties without your approval at the time of collection. We may pass your information to carefully selected affiliated third parties whom we work with.

MARKETING MATERIALS

By purchasing from TFE / IOM, you may receive marketing communications from us about similar products and services under the soft opt-in rules applicable to existing customers under UK law. Where you opt in for a free product or service, we will ask for your explicit consent before adding you to our mailing list via an email opt-in process. Once on our mailing list, you have the right to opt out at any time by clicking the unsubscribe button in any email. If you wish to be entirely removed from any marketing material or email lists, you can contact us at any time at [email protected] and we will action your request promptly.

AGE LIMITED FOR USE OF THE SITE

TFE / IOM is designed to be used by adults only. You are required to be over the age of 18 in order to use our services and by continuing to use the website, you are confirming by your conduct that you are over 18 years of age. We do not knowingly collect any information from children under the age of 18. If we become aware that we have inadvertently collected personal data from a child under 18 without appropriate consent, we will take steps to delete that information as soon as possible.

We are committed to keeping your email address confidential. We will not sell it, rent it or lease out your email to any third party. Your email is solely for IOM's use.

YOUR ACCESS TO AND CONTROL OVER INFORMATION

If you do not wish TFE / IOM to retain information about you, you can:

  • Change/correct any data we have about you.
  • Have us delete any data we have about you.
  • Express any concern you have about our use of your data.
  • Request that we delete all data about you. Note you cannot use the site or be a customer (for example a course or membership member) if we have no data on you as mentioned above.

If you are unhappy with how we have handled your personal data and we have been unable to resolve your concern through our usual support process, you have the right to lodge a complaint with the Information Commissioner's Office. 

SECURITY

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for "https" at the beginning of the address of the Web page.

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

SURVEYS AND CONTESTS

  • Release or share your password with anyone other than the paying account holder. Sharing login details with someone else is likely to result in the automatic suspension of your account as such practice is monitored.
  • Use any photos from our site without express written permission

USE OF PAID FOR ACCOUNTS

Should you purchase a course, program or membership with IOM, we may provide you with a username and a password. This enables you to access parts of the website that only paying users have access to. You agree that you will keep your username and password confidential, will not share it with anyone else and will not allow another person to login to your account using your details. Please note that we monitor logins via IP addresses so are able to detect if another person is using your login.

TESTIMONIALS

We reserve the right to use any testimonial that you provide for us wherever you have provided that testimonial along with your profile photo. All testimonials are real from real customers and based on the experience of that customer. They reflect real life experiences of an individual. We may not reproduce the entire testimonial if it is long or contains confidential data. We are not responsible for the opinions or comments in testimonials. Individual experiences are unique to an individual so testimonials do not provide a guarantee that you will have the same experience as another user. All testimonials are reviewed by management before being put on the IOM websites or elsewhere.

CHANGES TO THIS POLICY

IOM/TFE reserves the right to make changes to this Privacy Policy at any time at its sole discretion. Where we make any substantial changes, we will notify you by email or by placing a prominent notice on the website. Any changes will take effect from the date they are posted on the website and your continued use of the website after that date will constitute your acceptance of the updated policy.
